§ 139-10. Responsibility of homeowners' associations.
Latest version.
All homeowners' associations having duties with respect
to real property located within the Town of Malta (including both
common areas and real property owned by its members) shall maintain
all sidewalks located within the boundary lines of the association
property and privately owned property of its members by keeping such
sidewalks reasonably free of debris, snow or ice, or other obstructions
or substances or to make the sidewalk otherwise reasonably safe within
a reasonable time after the accumulation of the same, said time not
to exceed 48 hours. All such homeowners' associations shall maintain
such sidewalks by keeping them free from defects, such as cracks,
gaps, holes, protrusions or raised sections, within a reasonable time
after such defect has developed, said time not to exceed four weeks.
The duties of homeowners' associations set forth in this chapter
may not be delegated to members of such homeowners' associations.
Homeowners' associations for Highpointe at Malta PDD are exempt
from this article. All other language in this chapter notwithstanding,
homeowners' associations within Luther Forest PDD are not responsible
for the maintenance of the shared-use path parallel to Dunning Street.
