§ 167-39. Penalties for offenses.

A.Notification of violations. Written notice of violation signed by the Code Enforcement Officer shall be served upon the person or persons committing such violation and/or the property owner, either personally or by mail addressed to such person or persons at his or her last known address. Each week's continued violation shall constitute a separate additional violation.B.Complaints. Whenever an alleged violation of this chapter occurs, any person may file a complaint in regard thereto. All such complaints must be in writing and shall be filed with the Code Enforcement Officer who shall properly record such complaint and immediately investigate and report thereon.C.Penalties.(1)A first violation of this chapter is a first offense, punishable by fine not exceeding $250 or imprisonment for a period not to exceed 15 days, or both. For the purpose of conferring jurisdiction upon courts and judicial officers generally, violation of this chapter shall be deemed a misdemeanor and for such purpose all provisions of law relating to misdemeanors shall apply to such violation. In addition thereto, the Town authorities shall have such other remedies as are provided by law to restrain, correct or abate any violation of this chapter.(2)For a second offense within five years of the first offense: a fine of not less than $350 and not more than $700 or not exceeding six months' imprisonment, or both.(3)For a third or subsequent offense within a five-year period: a fine of not less than $700 nor more than $1,000 or not exceeding six months' imprisonment, or both.
